Cremeens Law Group PLLC has successfully had another client approved in Spring Hill, Florida for disability insurance benefits.
A client came to us suffering from medical conditions including degenerative joint disease, fibromyalgia, carpal tunnel syndrome, migraines, and microcytic anemia. CIGNA denied her claim based on their reviewing physician’s opinion that “pain is associated with fibromyalgia and exercise is encouraged to help reduce the pain. Staying off work is not the standard of care for fibromyalgia” but then went on to state that the client worked in a sedentary occupation and the restrictions and limitations wouldn’t preclude her from being able to work a sedentary job.
In the first place, the medical opinion means nobody can ever be disabled by fibromyalgia which is absurd. In the second place, the insurer ignored the rest of the client’s disabling medical conditions which is unreasonable. Pursuant to our appeal, CIGNA reversed its decision and reinstated our client’s ongoing disability insurance benefits.
If you have been denied disability insurance benefits and suffer from fibromyalgia, or any other medical condition above or not listed, give our office a call to see if we can help you too! A denial letter will typically provide you with 180 days to submit an appeal, however, we ask that you call us as soon as possible to give our firm the opportunity to form a strong appeal and give you the best chance of success in the administrative process.
