Disability insurance approval in Melbourne, Florida

Another approval, this time in Melbourne, Florida.  Client came to us suffering from lymphedema, lipomatosis, history of a failed laminectomy, sleep apnea, as well as other conditions.  One of the unique aspects of this case was that the denial letter stated that the client was not disabled from any occupation and that the policy transitions from proving inability to perform your own occupation to any occupation after just one year, whereas the any-occ transition in most LTD policies occurs at 24 months.  The insurance company determined that the client was able to work at a sedentary position, and during the record gathering and peer review phase of the insurer’s investigation, our client obtained a new diagnosis from her treating physicians of Dercum’s disease, a rare disorder characterized by multiple, painful growths of fatty tissue called lipomas. Although the insurance company provided the medical records establishing the new diagnosis and treatment to their reviewing physician, it didn’t change his opinion.

 

Cremeens Law Group PLLC gathered and obtained substantial and detailed medical evidence to submit a 122-page appeal, which resulted in the insurer’s decision to overturn its decision to deny the benefits and approve the client’s disability insurance benefits at the administrative level, without having to file a lawsuit.
