DISABILITY INSURANCE BENEFITS:
Long-Term Disability benefits are designed to
provide benefits in the event that your ability to
work is interrupted. Most people have little idea
whether their employer or an insurance company
actually provides the disability benefits, or how
difficult it will be to collect the benefits in the
event they are needed. Typical disability insurance
benefits plans cover 50-70 percent of your lost
income minus other sources of income, with sixty to
two thirds being about average. If you or a loved
one has applied for disability insurance benefits
and has been denied, it may be in your interest to
consult an attorney. Coffman Law has considerable
experience resolving denials of disability insurance
benefit claims. Call us. We may be able to help you,
even if the insurance company has said they will not
pay.
ERISA: Disability insurance benefits
come in two main flavors: Those governed by the
Employee Retirement Income Security Act of 1974
("ERISA"), and those governed by state law. Under
most circumstances, state law provides a better
forum for resolution of an employee benefit dispute,
and a wider variety of available remedies. That is
certainly the case in Florida, where The Law
Office of William S. Coffman, Jr. Is located. ERISA
governs most employee benefit plans.
